What personal information is collected and used by FitneX?

Users of our website remain anonymous until they decide otherwise. The information contained in system logs (e.g. IP address) resulting from the general rules of Internet connections is used by Fitnex for technical purposes related to the administration of our servers. In addition, IP addresses are used to collect general, statistical demographic information (e.g. about the region from which the connection is made). Subscribing to Fitnex requires filling out a form in which you must provide information enabling contact with the user (e.g. email address) and demographic information (e.g. gender). The information provided in the form is used by us to make necessary contacts with our users and to better adapt the content we present to their needs and interests.

What is Fitnexs policy regarding "cookies"?

Your web browser may store text files ("cookies") on your computer's disk. "Cookies" contain information necessary for the proper functioning of the portal, in particular those requiring authorisation. The content of cookies does not allow user identification. Personal data is not processed or stored using cookies.

How is the information protected?

The form filled out by the user during signing up to Fitnex, as well as the very process of authorisation (logging in) to our resources is carried out by means of coded sessions that will significantly increase the protection of data transmission on the Internet. Data such as profile access passwords are encrypted using one-way encryption algorithms that prevent them from being decrypted later. The information is stored and processed by Fitnex with appropriate security measures that meet the requirements of UK law.

Is the provided personal information disclosed to other entities?

Fitnex contains or will contain features (e.g. reviews) in which the content entered by the user (e.g. content and signature of the opinion) becomes publicly available. The user may publish their content on these websites only after authorisation and may decide how to sign it himself/herself.

The right to view, correct and delete user information

Fitnex provides each user with a profile page accessible after authorisation. This site allows you to view, modify and delete personal information about you held by Fitnex. In the event that the user finds this solution insufficient, he/she may contact Fitnex in writing.

Freedom of choice

Fitnex gives its users the opportunity to choose whether and to what extent they want to use our features and share information about themselves. Most of our features are available without having to provide personal information, however, some features require subscribing. Subscribing to Fitnex is a voluntary decision and a user may opt out and delete his/her profile at any time.

Legal basis and purposes of processing of Partners' personal data by Fitnex

 

  1. Fitnex is the controller of the personal data of Partners who are natural persons. Fitnex fulfils the information obligation referred to in Art. 13 GDPR towards Partners upon Account Registration. The content of the information clause is available in the table at the end of the Appendix.
  2. Fitnex and Partner process Customers' personal data for their own purposes and are therefore separate controllers of their personal data.
  3. When the Customer uses the Application to make a Booking for a Partner's service:
  4. In order to enable Fitnex to provide services to the Partner within the Application, for which it is necessary to process the following personal data:
  5. it is necessary for the Partner to entrust the processing of personal data of such persons, for which reason the Partner and Fitnex shall conclude a Personal Data Processing Entrustment Agreement.
  6. The Partner is aware that the termination of the Personal Data Processing Entrustment Agreement shall result in Fitnex inability to provide services to the Partner under the Agreement to the extent requiring the processing of data of which the Partner is the controller, and therefore with the termination of the Personal Data Processing Entrustment Agreement Fitnex obligations in this regard shall expire.
  7. When the Partner uses the tools available within the Fitnexy services (e.g. calendar, reminders, marketing tools) - Fitnex will process the Customer's data on behalf of the Partner in accordance with the terms set out in the Personal Data Processing Entrustment Agreement, and the Partner will continue to be the controller of the Customer's personal data.
  8. The purposes for which the Partner may process the Customer’s data will depend on whether the Customer has given consents to the Partner to process his/her personal data and which consents he/she has given, whether the Customer has not withdrawn these consents or objected to the Partner's processing of his/her personal data.
  9. The Partner is also the controller of the personal data of the Customer with whom an agreement is concluded outside the Application (e.g. in a salon). If the entrusted data is submitted to the Application, he/she is still the data controller and Fitnex processes the data on behalf of the Partner on the basis of the Personal Data Processing Entrustment Agreement.
  10. Fitnex processes the data, including personal data, of the Partner only to the extent that enables the proper provision of services and the proper implementation of the Agreement. Fitnex is not responsible for the scope of the Customers' personal data collected by the Partners and for the legality of the collection of such data by the Partners. The detailed obligations of the parties in this regard are set out in the Personal Data Processing Entrustment Agreement.

Aims and legal basis of data processing

We process your personal data for the following purposes:

1 to conclude and perform a contract for the use of Booksy - such processing of your personal data is necessary for the performance of the contract (Art. 6(1)(b) GDPR);

2 marketing of Fitnexs products or services (excluding direct marketing) - the processing of your personal data for this purpose will be carried out in pursuit of  legitimate interest (Art. 6(1)(f) GDPR), which is to be able to market our own products and services;

3 direct marketing of Fitnex products or services - such processing of your personal data is necessary for the legitimate interest of Fitnex (Art. 6(1)(f) GDPR), which is the possibility of marketing our own products and services, consisting of direct communication with you for the purpose of advertising and promoting Fitnex services;

4 profiling/grouping (i.e. conducting analyses, which may also involve personal data, and grouping customers - in order to tailor our products or services and their marketing to your preferences, as well as to the preferences of specific customer groups identified by us) - the processing of your personal data for this purpose will take place in pursuit of our legitimate interest (Art.e 6(1)(f) GDPR);

5 to research preferences regarding the demand for Fitnex or Partners' services (e.g. via phone, text message or email surveys) - which is necessary to fulfil legitimate interest (Art. 6(1)(f) GDPR), which is the possibility to determine the catalogue of products and services of interest to customers and their level of satisfaction with Fitnex or Partners' services;

6 to establish, assert or defend against claims related to the concluded contract or to the processing of your personal data - the processing of your personal data in this regard is necessary to pursue the legitimate interest of Fitnex (Art. 6(1)(f) GDPR), which is the possibility to establish, assert or defend against possible claims;

Profiling/grouping

Please be advised that we perform profiling/grouping of customers in order to provide our services and to target advertising, reminders, recommendations and promotions as closely as possible to their and your preferences. Such profiling/grouping may be done on the basis of the following data:

1 activity on the website and in the Fitnex application;

2 geolocation;

3 gender;

4 time of using the Fitnex services;

5 time of last activity on the website or in the Fitnex application;

6 analysis of photos that customers have liked in Fitnex.

In doing so, we would like to clarify that Fitnex does not use intrusive profiling and tracking practices for marketing or advertising purposes.

The recipients of your personal data may be:

1 companies from the capital group Fitnex is part of;

2 entities authorised by law;

3 entities that provide accounting, IT, marketing, communication and analytical, legal and debt collection services;

4 Fitnex’s subcontractors and other entities with whom Fitnex cooperates.

We confirm that all entities to which we transfer your personal information provide at least the same level of protection for your personal information as set out in this privacy policy and as required by Apple Inc.

Transfer of data outside the European Economic Area

Your data will not be transferred to entities based outside the European Economic Area.

Period of data storage

We will process your data:

1 for the conclusion and performance of the contract - until the contract is terminated or expires, and then until the end of the limitation period for claims;

2 for marketing of products or services (except direct marketing) - until the termination or expiry of the contract or until you object to the processing of your data for this purpose;

3 for direct marketing of Fitnex products or services - until the termination or expiry of the contract or until you object to the processing of your data for this purpose;

4 for profiling/grouping purposes - until the termination or expiry of the contract or until you object to processing for that purpose;

5 for research into preferences in terms of demand for services - until the termination or expiry of the contract or until you object to processing for that purpose;

6 for the purpose of establishing, investigating or defending against claims - until the end of the limitation period for claims;

7 to comply with legal obligations - until the expiry of data retention obligations under the law;

8 in order to produce compilations, analyses, statistics for internal needs - for the duration of the agreement and then until the end of the limitation period for claims arising from the agreement or until an objection is raised to data processing for this purpose;

9 for the purpose of implementing new or developing new solutions/features of Fitnex systems/applications - until the termination or expiration of the contract or until you object to data processing for this purpose;

10 for the purpose of responding to your message and communicating with you when you send us a message - for the duration of the period of communication and then until the end of the limitation period for claims.

Your rights

In accordance with GDPR, you have the right to:

1 access your data and receive a copy of it;

2 rectify (amend, complete) your data;

3 have your data erased or data processing restricted;

Right to withdraw consent

You can withdraw your consent to the processing of your personal data at any time - this only applies to the processing of data that Fitnex will process on the basis of the consent you have given. To do this, you can send an email: support@fitnex.life or using the electronic form on www.fitnex.life                                                                                            The withdrawal of consent will not affect the lawfulness of data processing prior to the withdrawal of consent.

If you use the Fitnex application, you can check which consents you have given at any time and you can edit them by going to "Profile" > "Settings" > “Fitnex App" > "Your Data Protection" in the Fitnex application.

Right to object

You may object to the processing of your personal data by Fitnex with regard to the processing for Fitnex’s legitimate interest (Art. 6 (1)(f) GDPR). To do this, you can send us an email: support@fitnex.life or using the electronic form on www.fitnex.life                                               In such a case, Fitnex will no longer be permitted to process your personal data unless Fitnex demonstrates valid legitimate grounds for the processing which override your interests, rights and freedoms, or grounds for establishing, asserting or defending claims.

If you object to the processing for direct marketing purposes - in any case Fitnex will stop processing your personal data for this purpose.

Right to erasure

You have the right to request to have your personal data erased from the Fitnex website at any time by sending a request to have your personal data erased to: support@fitnex.life or using the electronic form on www.fitnex.life

If you use the Fitnex application on a device with the iOS system you can delete your account by going to "Profile" > "Settings" > “Fitnex App" > "Delete Your Account" tab and clicking the "Submit request" button. By deleting your account in the Fitnex application, you also erase your personal data from the Fitnex application.

Information about the requirement or the voluntariness of the provision of data and the consequences of failing to provide it

The provision of your personal data is voluntary, but necessary for the conclusion and performance of the contract, for the use of the Fitnex service and for the fulfilment of the other aforementioned purposes.

You can check or edit your personal data that you have provided to us at any time by going to "Profile" > "Settings" > "Business Details" in the Booksy application
